1. DEFINITIONS
In these Terms and Conditions, “Studio” means Lithgow Academy of Dance. “Student” means the enrolled child. “Parents/Guardians” means the person(s) responsible for payment and enrolment.

2. REGISTRATION & ENROLMENT
2.1 All Students must complete a Registration Form prior to attending classes.
2.2 Submission of the Registration Form constitutes acceptance of these Terms, Studio policies, and the Lithgow Academy of Dance Handbook.
2.3 Enrolment is ongoing and automatically renews each term unless cancelled in accordance with Clause 7.
2.4 While enrolled, Students may not undertake training at another dance school in the same styles offered by the Studio without prior written consent, except for school programs, workshops, or special events approved by the Studio.

3. FEES & PAYMENT
3.1 Fees are charged on an all-inclusive basis according to the number of classes attended.
3.2 Payment options are full-term upfront payment or weekly instalments.
3.3 Payments may be made via credit card, direct debit, or direct bank transfer. Bank transfers must include the Student’s full name as payment reference. Proof of payment may be required.
3.4 Parents/Guardians are responsible for ensuring sufficient funds are available. Failed payments may incur bank or merchant fees and may result in suspension of classes until resolved.
3.5 A non-refundable annual registration fee applies ($65 new Students / $35 returning).

4. PARENT/GUARDIAN RESPONSIBILITY FOR COMMUNICATIONS
4.1 It is the responsibility of Parents/Guardians to receive, access, and read all communications sent by the Studio. Communications may be delivered via email, SMS/text message, phone calls, or the Studio’s communication platforms, including Band.
4.2 Parents/Guardians acknowledge that important information, including class updates, timetable changes, fees, costume details, rehearsal schedules, Showcase information, and other Studio announcements, will be communicated through these channels.
4.3 The Studio is not responsible for missed information if a Parent/Guardian fails to maintain current contact details or does not access messages sent via these channels.
4.4 By enrolling, Parents/Guardians accept that it is their responsibility to regularly check and act on all communications from the Studio.
4.5 Parents/Guardians acknowledge that failure to read or act on communications does not absolve them from obligations, fees, or responsibilities relating to classes, rehearsals, or Showcase participation.

5. MISSED CLASSES & CREDITS
5.1 No refunds are provided for missed classes due to illness, holidays, or personal circumstances.
5.2 Make-up classes may be offered subject to availability.
5.3 Where a make-up is not possible, a credit may be applied and must be used within the current or following term.

6. SHOWCASE & PERFORMANCE PARTICIPATION
6.1 Participation in Studio showcases, concerts, or performances (“Showcase”) is considered an integral part of the Studio program unless otherwise stated.
6.2 Showcase participation may incur additional fees, including but not limited to costume hire or purchase, tickets, rehearsal fees, photography, videography, and production costs. These fees are published on the Studio website at http://nadanceco.com.au/showcase-portal. By enrolling, Parents/Guardians explicitly acknowledge and accept these fees.
6.3 Costume Orders and Sizing:

• Costume orders are final. Once a costume has been ordered, exchanges or changes to a different size will not be permitted under any circumstances.
• Costume sizes must be submitted by the deadline specified by the Studio. Failure to submit on time constitutes acceptance of the size ordered by the Studio.

6.4 Students must attend all scheduled rehearsals and performances associated with the Showcase. Failure to attend may result in the Student being withdrawn from the performance at the discretion of the Studio, without refund of any Showcase-related fees.
6.5 Showcase fees are non-refundable once costumes or production costs have been committed.
6.6 The Studio reserves the right to modify Showcase arrangements, venues, dates, or content where required. Reasonable notice will be provided where practicable.
6.7 Submission of enrolment and/or acceptance of Showcase fees constitutes explicit acknowledgement and agreement by Parents/Guardians to all Showcase rules, fees, and deadlines set out in these Terms, the NA Dance Company Handbook, and on the Studio website.

7. CANCELLATION & WITHDRAWAL
7.1 Written notice of cancellation must be received at least four (4) weeks prior to the end of term.
7.2 Failure to provide notice may result in fees being charged for the following term.
7.3 Withdrawal mid-term does not entitle the Parents/Guardians to a refund for remaining classes.
7.4 Future weekly payments will cease once valid written notice is received.

8. CLASS CHANGES
8.1 The Studio reserves the right to change class times, venues, teachers, or timetables where necessary.
8.2 Reasonable notice will be provided and make-up classes offered where practicable.

9. CODE OF CONDUCT
9.1 Students must comply with Studio behaviour and dress code standards.
9.2 Parents and siblings must remain quiet and respectful in waiting areas, and children must be supervised at all times.
9.3 The Studio reserves the right to terminate enrolment for behaviour deemed unsafe, disruptive, or abusive.

10. PHOTOGRAPHY & MEDIA
10.1 Parents may photograph their own child only.
10.2 The Studio may photograph or record Students for promotional purposes unless written opt-out is received.
10.3 Images may be used across digital and print platforms.

11. MEDICAL & RISK
11.1 Dance is a physical activity and participation is at the Student’s own risk.
11.2 Parents/Guardians authorise staff to administer basic first aid and seek emergency medical treatment if required.
11.3 Parents/Guardians are responsible for all medical costs incurred.

12. LIABILITY
12.1 To the extent permitted by law, the Studio is not liable for injury, loss, or damage arising from participation in classes or performances.
12.2 Nothing in these Terms excludes rights under the Australian Consumer Law.

13. GOVERNING LAW
These Terms are governed by the laws of New South Wales, Australia.

14. AMENDMENTS TO TERMS
The Studio reserves the right to update these Terms & Conditions at any time. Updated terms will be published on our website, and continued enrolment constitutes acceptance of the revised terms.
